Terms of Service

1. Agreement to Terms

By accessing tolgacagin.com or purchasing a subscription, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use my services.

2. Services

I provide WordPress development services on a monthly subscription basis. Services include custom theme development, WooCommerce integrations, headless WordPress builds, performance optimization, and ongoing maintenance. The specific scope depends on your chosen plan.

Subscriptions are managed through the Client Portal at tolgacagin.com/portal.

3. Subscription Plans

I offer the following subscription plans:

  • Build — one active request at a time, one weekly meeting
  • Build Pro — two active requests at a time, two weekly meetings
  • Maintenance — content edits, plugin and core updates, security monitoring, database cleanup

All plans are billed monthly with no long-term commitment. You may cancel at any time.

4. Payments & Billing

Payments are processed through iyzico, a PCI-compliant payment gateway. By subscribing, you authorize recurring monthly charges to your payment method. Your card information is stored securely by iyzico and is never held on my servers.

All prices are listed in US Dollars (USD). Charges are non-refundable for the current billing period once work has commenced.

5. Cancellation & Pausing

You may cancel your subscription at any time. Upon cancellation, you will retain access to services until the end of your current billing period. No partial refunds are issued for unused time within a billing cycle.

You may pause your subscription at any time. While paused, no new requests will be processed and billing is suspended. Your subscription remains paused until you choose to unpause it.

6. Request Turnaround

Average turnaround time is 3–6 business days per request, depending on complexity. This is an estimate, not a guarantee. More complex requests may take longer. I will communicate expected timelines for each request.

7. Intellectual Property

Upon full payment, you own all custom code, designs, and assets created specifically for your project. I retain the right to showcase the work in my portfolio unless you request otherwise in writing.

Third-party plugins, themes, and libraries used in your project remain subject to their respective licenses.

8. Client Responsibilities

You are responsible for:

  • Providing timely feedback and necessary access to complete requests
  • Ensuring you have the legal right to use any content, images, or materials you provide
  • Maintaining the security of your Client Portal account credentials
  • Keeping your own backups of critical data and content

9. Limitation of Liability

My services are provided "as is." I am not liable for any indirect, incidental, or consequential damages arising from the use of my services. My total liability shall not exceed the amount paid by you in the most recent billing period.

I am not responsible for downtime, data loss, or issues caused by third-party hosting providers, plugins, or services outside my control.

10. Confidentiality

I treat all client information, code, and business data as confidential. I will not share your project details with third parties without your consent, except as required by law.

11. White-Label Work

For agency clients using my white-label services, I will not disclose our working relationship to your end clients. White-label arrangements should be discussed and agreed upon before the start of the project.

12. Termination

I reserve the right to terminate or suspend your subscription if you violate these terms, engage in abusive behavior, or use my services for unlawful purposes. In such cases, no refund will be issued for the current billing period.

13. Changes to These Terms

I may update these Terms of Service from time to time. Changes will be posted on this page with an updated revision date. Continued use of my services after changes constitutes acceptance of the new terms.
